Social Media Giveaway Terms and Conditions
THIS OKX SOCIAL MEDIA GIVEAWAY IS NOT AVAILABLE TO YOU, AND YOU ARE NOT ELIGIBLE TO PARTICIPATE IF YOU ARE NOT LOCATED IN THE GIVEAWAY CONFIRMED JURISDICTION(S) AT THE MOMENT OF THE CAMPAIGN
These Social Media Giveaway Terms and Conditions (the “Terms”) are an agreement between you (“User” or “you”) and OKCoin Europe Ltd (“OKX,” “we,” “us,” or “our”). These Terms govern your access to and participation in our social media giveaway (the “Giveaways”) (collectively, the “Agreement”).
No purchase necessary. Transactions, purchases, or payments of any kind will not increase your chances of winning. Participation is limited to legal residents of the Netherlands and Belgium. The social media giveaways of OKX are void where prohibited or restricted by law and are exclusively governed by the laws of Malta.
By accessing the Giveaways, you confirm that you have read, understood, and accepted the Agreement and are legally bound by these Terms, regardless of your location or nationality. If you do not agree to the Agreement, do not access or participate in the Giveaways.
Eligibility
1.1 Entrant Eligibility. This giveaway is only open to legal residents of the area described in the original giveaway post, who are at least 18 years old or have reached the legal age of majority in their respective place of residence. All participants must comply with this Agreement and all applicable service terms, terms of use, announcements, and other operational rules (“User Agreements”) as amended and revised from time to time by OKX, and must meet these eligibility requirements. Determination of compliance is at the sole discretion of OKX.
1.2. Eligible Jurisdiction. The Giveaways are only available to residents of or those located in the area described in the original social media post. By accessing the Giveaways, you represent and warrant that at the time of access you are a resident of and located in the area described in the social media post.
1.3 Non-Eligible Parties. OKX, its parent company, subsidiaries, affiliates, promotional agencies, sales representatives, and each of their respective directors, officers, employees, and agents (collectively, the “Promotional Parties”) are not eligible to participate in the Giveaways or win a prize. This also applies to their respective immediate family members and/or those living in the same household (whether related or not). For purposes of this Agreement, a “family member” includes any spouse, partner, parent or stepparent, legal guardian, in-law, grandparent, child or stepchild, sibling or stepsibling, and grandchild.
1.4 Additional Eligibility Criteria and Change of Rules. Please note that additional rules and eligibility requirements may be announced through other channels, such as OKX’s X account or social media. OKX reserves the right to change the terms of the Giveaways at any time at its sole discretion. Furthermore, OKX reserves the right to disqualify participants who exhibit signs of fraud, at OKX’s sole discretion.
1.5 Legal and Regulatory Restrictions. The Giveaways are subject to all applicable laws and regulations and are void where prohibited or restricted by law.
How to Enter
2.1 Prize. Prizes consist solely of the items specifically listed and described as part of the giveaway. Prizes cannot be exchanged for cash, crypto, or other alternatives.
Participation in the Giveaways is free of charge.
Without prejudice to the foregoing, participants wishing to be eligible to win the prize for each Giveaway must follow the procedures set forth in this Agreement and other User Agreements, including but not limited to the following:

2.2 Limitations on Entry. Limit of one (1) entry per person per household during the Giveaway Period (as defined below). Any entry or entries submitted by a person through another account, or attempting to create an additional account during the Giveaway Period, will be disqualified. Attempts by a participant to obtain more than the stated number of entries by using multiple and/or different email addresses or any other method will void all entries of that participant and may result in disqualification. Use of an automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to the identity of a potential winner, the entry will be deemed to have been made by the authorized account holder of the email address associated with the participant's OKX account (“Participant Email Address”). A potential winner may be required to provide sufficient identification to demonstrate that they are the authorized account holder of the email account. For the purposes of this section, the “authorized account holder” is the natural person assigned to the email account in question. Proof of submission of an entry does not constitute proof of delivery.
Prizes
A total of 1 prize will be awarded per winner who follows the procedures to receive the prize (the “Prize”), as described in the relevant social media post made by the influencer (the “Giveaway Post”).
No cash alternative will be offered.
Prizes are non-transferable and no substitutions will be made, except as provided in this Agreement and at the sole discretion of OKX. Prizes consist solely of the items specifically listed and described as part of the Prize. In no event will more than the stated number of Prizes be awarded.
Giveaway Period
The User must perform the required actions to participate between the outlined period as described in the original giveaway post.
Winner Selection
5.1 Winner Selection. Winners will be selected from all valid entries received during the Giveaway Period. Odds of winning depend on the total number of valid entries.
5.2 OKX's Confirmation is Final and Binding. Winners will be selected within fourteen days after the end of the Giveaway Period. The decision of OKX is final and binding.
Winner Notification and Claiming Prizes
6.1 Potential Winner Notification. Winners will be notified via their social media account by an OKX representative and must respond within 24 hours.
6.2 Verification and Delivery. OKX will contact winners to obtain their shipping address. Information will be processed in accordance with the Privacy Policy
6.3 Disqualification. If a winner fails to respond within 24 hours, declines the prize, or if the prize is undeliverable, the winner will be disqualified without further notice and an alternative winner may be selected.
6.4 Prize distribution. Prize distribution will occur within thirty days after verification of the winner. OKX is not liable for undelivered emails resulting from any form of active or passive email filtering by the participant’s email or insufficient space in the participant’s account to receive emails. Such cases will be considered a loss of the prize and no compensation will be provided. OKX will have no further obligations to the participant in such cases.
6.5 Transfer or Substitution Terms. Prizes are non-transferable and no substitutions will be made, except as provided in these rules and at the sole discretion of OKX. OKX reserves the right to substitute a prize with one of equal or greater value if the designated prize becomes unavailable for any reason. Prizes consist solely of the items specifically listed and described as part of the prize. In no event will more prizes be awarded than the stated number.
6.6 Undeliverable Prizes. Details of prizes not specifically listed in these rules will be determined at OKX’s sole discretion. OKX is not responsible for and will not replace any prize that is undeliverable or for any lost, damaged, or stolen prize(s) or parts of a prize.
Taxes and Shipping
OKX will only ship the prize to jurisdictions in the EEA (European Economic Area) served by local shipping services. OKX reserves the right, at its sole discretion, not to ship prizes to persons in jurisdictions where shipping is otherwise impractical. OKX will make efforts to cover customs duties.
Representations and Warranties
OKX makes no representations or warranties regarding the Giveaway. All calculations for the final Giveaway prizes are verified by OKX and the associated calculation methods are listed in these rules, but OKX does not guarantee that these calculations will be free of errors or interruptions.
Disclaimers and Limitations of Liability
9.1 Limited liability. To the maximum extent permitted by law, OKX disclaims any liability not expressly included in these Terms. Unless otherwise legally required, OKX, including its directors, members, officers, employees, or agents, shall not be liable for any special, indirect, or consequential damages, or any other damages of any kind, whether arising in contract, tort (including but not limited to negligence), or otherwise related to or resulting from the promotion. This includes, but is not limited to, damages arising from or resulting from a participant’s reliance on information obtained from OKX, or damages resulting from errors, omissions, interruptions, delays in operation or transmission, or any performance issues, whether or not caused by force majeure. The total liability of OKX, its directors, members, officers, employees, or agents, individually or collectively, shall in any case be limited to a maximum of ten US dollars ($10 USD).
9.2 No Liability of Third Parties. Third parties are not organizers of this giveaway and accept no liability whatsoever.
Governing Law and Dispute Resolution
10.1 Governing Law. Participants agree that, to participate in the Giveaways, any claims, disputes, and legal actions of any kind directly or indirectly arising out of or related to the Giveaways shall be governed by and interpreted in accordance with the laws of Malta, without regard to any conflict of law principles.
10.2 Arbitration. This Agreement shall be governed by and interpreted in accordance with the laws of Malta. Any dispute, controversy, or claim arising out of or in connection with this Agreement, or its breach, termination, or invalidity, shall be settled by binding arbitration in accordance with Part IV (Domestic Arbitration) of the Malta Arbitration Act and the Domestic and International Arbitration Rules/Procedures of the Malta Arbitration Centre, as amended by this Agreement. Arbitration shall take place in Malta before a single arbitrator, who shall be a retired judge. The parties shall bear their own attorney and arbitration fees, unless the arbitrator decides otherwise. The parties shall share the arbitrator’s fees and expenses equally.
10.3 No Class Actions. Participants agree that OKX is not obligated to provide general document discovery, but may only be required to produce specifically identified documents that are relevant and material to the outcome of the dispute.
10.4 Final and Binding Nature. Any arbitral award shall be final and binding on the parties and may be enforced in any court of competent jurisdiction.
10.5 No Class Action or Litigation. Participants agree to resolve all disputes with OKX individually through arbitration, and not as part of a class or representative action.
OKX's Privacy Policy
All information provided by participants is subject to the OKX Privacy Statement and/or the applicable privacy documentation of OKX in your country. By participating in the Giveaway, you grant OKX permission to share personally identifiable information for the purposes of administration and prize distribution.
Social Media Disclaimer
12.1 Required Accounts. An X and/or Instagram account may be required for participation.
12.2 No affiliation to Social Media Platform. This giveaway is not sponsored, endorsed, or administered by X or Instagram.
12.3 Required Information. All participants understand and agree that they are providing their information to OKX and not to X or Instagram.
Miscellaneous
13.1 Entire Agreement. All relevant terms, User Agreements, policies, rules, and announcements (as amended, supplemented, and revised from time to time) published on OKX’s website constitute the full and entire agreement and understanding between you and OKX regarding this Giveaway.
13.2 New Notices, Announcements, and Updates. OKX may from time to time, at its discretion, post further announcements with more details about the Giveaways. Please read and review these notices, announcements, and updates regarding the Giveaways carefully in order to be eligible for the prizes offered in the Giveaways. Your continued participation in the Giveaways after receiving such notices will be deemed your acceptance of the relevant announcements.
13.3 Right to Modify or Intervene. OKX reserves the right to exclude participants from the Giveaways without notice and to cancel this Giveaway without notice, at its sole discretion.
13.4 Final Decision and Interpretation. OKX reserves the right to interpret the Terms of the Giveaways at its discretion and reserves the right to modify or amend these Terms at any time at its sole discretion.
13.5 Disclaimer. This activity does not constitute (i) investment advice or investment recommendation; (ii) an offer or solicitation to buy or sell digital assets; or (iii) financial, accounting, legal, or tax advice.
